TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing, ordering, registering for, or using any services provided by SRVSKY, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. By clicking any acceptance button, creating an account, submitting an order, or making a payment, you provide a legally binding electronic acceptance of these Terms.

2. LEGAL ENTITY & GOVERNING LAW

SRVSKY is a brand operated by Qovintra Global LLC, a legally registered entity in the State of Wyoming, USA. These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming, USA.

3. SERVICE SCOPE

SRVSKY provides dedicated GPU infrastructure, bare-metal compute resources, and related provisioning services through srvsky.com and its associated billing portal. Unless otherwise stated in writing, all services are provided for professional and lawful use only. Unless explicitly stated otherwise in writing, services are provided on an unmanaged basis, and users remain solely responsible for the operating system, software installation, updates, security hardening, and data inside their deployed environments.

4. REGISTRATION INFORMATION & ACCOUNT ACCURACY

Users agree to provide accurate, current, and complete account, billing, identity, and contact information as requested by SRVSKY, and to keep such information updated at all times. SRVSKY reserves the right to suspend, restrict, or terminate any account associated with false, misleading, outdated, or incomplete information.

5. PROVISIONING, ACTIVATION & ORDER ACCEPTANCE

Service provisioning begins only after successful payment confirmation and internal acceptance of the order. Provisioning times may vary depending on product type, configuration, fraud screening, compliance review, and infrastructure availability. SRVSKY reserves the right to reject, delay, suspend, or cancel any order at its sole discretion. If an order is declined before service activation, Qovintra Global LLC may issue a refund or billing reversal as appropriate to the circumstances.

6. ACCOUNT SECURITY & USER RESPONSIBILITY

Users are solely responsible for maintaining the confidentiality of their account credentials, API keys, SSH keys, access tokens, and any credentials used within deployed environments. Qovintra Global LLC shall not be liable for unauthorized access, loss, or damage resulting from weak passwords, credential leakage, or user-side security failures.

7. MULTIPLE ACCOUNTS & ACCOUNT ABUSE

Unless otherwise approved in writing, users may not create or operate multiple accounts for abusive, deceptive, promotional, circumvention, or fraud-related purposes. SRVSKY reserves the right to restrict, merge, suspend, or terminate duplicate or abusive accounts.

8. SERVICE COMMUNICATIONS

Users acknowledge that operational, administrative, billing, compliance, security, and service-related communications are an essential part of the services and may be delivered by email or other designated channels. Users may not opt out of critical service-related communications.

9. PAYMENTS, BILLING & TAXES

All charges are billed in USD unless otherwise stated. Payments are processed through available third-party payment providers displayed at checkout. Users are responsible for maintaining valid payment methods and for paying any applicable taxes, duties, or local governmental charges associated with their use of the services.

10. REFUNDS & CANCELLATIONS

Due to provisioning, allocation, and infrastructure reservation costs, services are generally non-refundable unless otherwise stated in writing. Refund requests, if any, are reviewed on a case-by-case basis. Verified service failures may be evaluated in accordance with any applicable service commitment published by SRVSKY. Cancellation of a service does not automatically entitle the user to a refund for unused time unless explicitly stated otherwise in writing.

11. CHARGEBACKS & PAYMENT DISPUTES

Users agree to contact SRVSKY support before initiating a chargeback or payment dispute. Fraudulent, abusive, or bad-faith chargebacks may result in immediate suspension or termination of services, account closure, and deletion of associated data, subject to internal review by Qovintra Global LLC.

12. ACCEPTABLE USE

Users may not use SRVSKY services for unlawful, abusive, or prohibited activities, including but not limited to: distributing malware, ransomware, or malicious code; launching DDoS attacks, port scanning, or unauthorized probing; sending unsolicited bulk communications or spam; hosting or distributing illegal content; unauthorized cryptocurrency mining or resource abuse; attempting to bypass service limits, security controls, or access restrictions; any activity that threatens platform integrity, security, lawful operation, or the rights of others. SRVSKY reserves the right to suspend, restrict, investigate, or terminate any service involved in prohibited use.

13. THIRD-PARTY SOFTWARE & LICENSE COMPLIANCE

Users are solely responsible for ensuring that any third-party software installed, uploaded, licensed, or used within the services is lawfully obtained and used in compliance with all applicable license terms, end-user license agreements, and legal restrictions. SRVSKY may suspend or terminate services associated with suspected software piracy, unauthorized licensing, or unlawful software use.

14. EXPORT CONTROLS, SANCTIONS & RESTRICTED USE

Users may not access or use the services in violation of applicable export control laws, trade restrictions, or sanctions regulations of the United States or other applicable jurisdictions. SRVSKY reserves the right to refuse service, suspend accounts, or terminate services where required for legal or compliance reasons, including where a user, entity, or jurisdiction is restricted by applicable law.

15. SUSPENSION, SERVICE CHANGES & TERMINATION

SRVSKY may suspend, restrict, modify, discontinue, or terminate services immediately if a user violates these Terms, fails payment obligations, engages in abusive conduct, or creates operational, legal, or security risk. SRVSKY also reserves the right to modify service features, technical specifications, pricing structures, product availability, or deployment conditions at any time. Suspension or termination does not relieve the user of any outstanding payment obligations.

16. MAINTENANCE, AVAILABILITY & PERFORMANCE

Services may be subject to scheduled maintenance, emergency maintenance, upgrades, replacements, or operational adjustments that may temporarily affect availability or performance. While SRVSKY seeks to provide reliable infrastructure, continuous availability, uninterrupted access, specific performance levels, or workload compatibility are not guaranteed unless explicitly stated in a separate written agreement or service commitment.

17. DATA RETENTION & DELETION

Upon expiration, cancellation, termination, or non-payment, SRVSKY may permanently delete data stored within the affected service after a grace period of 24 hours, unless otherwise stated in writing. Users are solely responsible for exporting and securing their own data before service termination. Qovintra Global LLC shall not be liable for data loss after the grace period.

18. DATA, CONTENT & USER MATERIALS

Users retain ownership of their own data, files, configurations, and content deployed on or transmitted through the services. Users represent and warrant that they have all necessary rights, permissions, and legal authority to use, store, process, and transmit such materials. Qovintra Global LLC does not claim ownership of user content and assumes no responsibility for the legality, accuracy, or integrity of user-supplied materials.

19. CONFIDENTIALITY & NDA

SRVSKY will handle customer business information with reasonable confidentiality in the ordinary course of service delivery. Separate non-disclosure agreements may be made available to qualified business customers upon written request and mutual acceptance.

20. INTELLECTUAL PROPERTY

SRVSKY and Qovintra Global LLC retain all right, title, and interest in and to their services, systems, software, portal interfaces, branding, documentation, workflows, scripts, automation tools, and related intellectual property. Except as expressly permitted, users may not copy, reverse engineer, modify, distribute, republish, decompile, disassemble, or create derivative works from any part of the services or related technology.

21. NO BACKUP WARRANTY

Unless explicitly stated otherwise, SRVSKY does not provide managed backup services. Users are solely responsible for maintaining their own backups, snapshots, encryption keys, operating system configurations, and recovery procedures.

22. INVESTIGATIONS & LEGAL COMPLIANCE

SRVSKY reserves the right to investigate suspected violations of these Terms, security incidents, payment fraud, abuse complaints, or unlawful activity. Qovintra Global LLC may cooperate with law enforcement authorities, regulators, payment providers, or other competent parties where required by law, legal process, or legitimate compliance needs.

23. DISCLAIMER OF WARRANTIES

Services are provided on an “as is” and “as available” basis, to the maximum extent permitted by law. Qovintra Global LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

24. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Qovintra Global LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of revenue, data loss, business interruption, or procurement of substitute services, arising out of or related to the use of, or inability to use, the services. Notwithstanding anything to the contrary, the aggregate liability of Qovintra Global LLC arising out of or related to the services shall not exceed the total fees actually paid by the customer to SRVSKY during the three (3) months immediately preceding the event giving rise to the claim.

25. INDEMNITY

You agree to defend, indemnify, and hold harmless Qovintra Global LLC, its officers, affiliates, operators, employees, contractors, and agents from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the services, your data or content, your violation of these Terms, or your violation of any applicable law or third-party rights.

26. ASSIGNMENT

Users may not assign, transfer, resell, or otherwise dispose of their accounts or contractual rights under these Terms without prior written consent from Qovintra Global LLC.

27. NO WAIVER

Failure by Qovintra Global LLC to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other provision.

28. SEVERABILITY

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

29. SURVIVAL

Any provisions which by their nature should survive suspension, termination, or expiration of the services shall survive, including provisions relating to payment obligations, intellectual property, liability limitations, indemnity, confidentiality, data retention, and dispute-related matters.

30. ENTIRE AGREEMENT

These Terms, together with any policies or documents expressly incorporated by reference, constitute the entire agreement between the parties regarding the services and supersede all prior or contemporaneous understandings, communications, or agreements relating to the subject matter.

31. FORCE MAJEURE & CHANGES TO TERMS

Qovintra Global LLC shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, cyber incidents, power failures, or datacenter outages. SRVSKY reserves the right to modify these Terms at any time. Updated versions become effective upon publication on the website unless otherwise stated. Continued use of the services after any update constitutes acceptance of the revised Terms.
